Dispute Resolution 

Every state must establish procedures to resolve disputes regarding the educational placement of homeless students promptly.

Whenever a dispute arises, the student must be admitted immediately to the requested school site while the dispute is being resolved.

If the student is sent to a school other than the school of origin or the school requested by  the parent or guardian, the LEA must provide the parent of guardian with a written explanation of its decision and the right to appeal.

The school must refer the student, parent, or guardian to the local liaison to carry out the dispute resolution process as expeditiously as possible.

Local liaisons must ensure that the same access to dispute resolution process is provided to unaccompanied youth.

McKinney – Vento Educational Rights of Students

  1. Go to school, no matter where they live or how long they have lived there.
  2. Attend either the local school (school of residence) or the school of origin.  The school of origin is the school they child attended when he/she was permanently housed or the school in which the child was last enrolled.
  3. If feasible, receive transportation to and from the school of origin.
  4. Enroll in school immediately, even if missing records and documents normally required for enrollment.
  5. Enroll, attend classes, and participate fully in all school activities while in school arrange for the transfer of records.
  6. Have access to the same programs and services that are available to all other students including transportation and supplemental educational services.
  7. Attend school with children not experiencing homelessness; segregation based on a student’s living status as homeless is prohibited.
